End User Terms of Service

These End User Terms of Service ("Terms") govern your use of event registration pages, donation pages, auction pages, and all other public-facing features powered by the ChipIn platform (collectively, the "Platform"). The Platform is operated by ChipIn LLC, a New Hampshire limited liability company ("ChipIn," "we," "us," or "our").
By registering for an event, making a donation, placing a bid, or otherwise interacting with a ChipIn-powered page, you agree to these Terms. Please read them before proceeding.
1. What ChipIn Is and Is Not
1.1 We are the platform, not the organizer.
ChipIn provides software that enables organizations and individuals (collectively, "Organizers") to manage charitable fundraising events and campaigns. We are not the Organizer of the event you are registering for or donating to. The Organizer is the nonprofit, association, or other entity whose name appears on the event page.
1.2 Your interaction is with the Organizer.
When you interact with an event through the Platform — whether registering, donating, bidding, or any other activity — that interaction is between you and the Organizer. ChipIn is not a party to that relationship. Your registration, payment, and any commitments made to you are the sole responsibility of the Organizer.
1.3 We do not endorse or guarantee.
ChipIn does not verify, endorse, or guarantee: the accuracy of any information published by an Organizer; that the event will take place as described; that auction items will be delivered; or that funds raised will be used for the purposes stated by the Organizer. If you have questions about an event, its purpose, or how proceeds will be used, contact the Organizer directly.
1.4 We do not own your funds.
End User payments are processed on behalf of the Organizer. ChipIn does not own End User funds. The Organizer is responsible for all transactions with End Users.
2. Age Requirements
2.1 Payments and bids.
To make a payment, donation, or bid through the Platform, you must be at least 18 years old, or if you are between 13 and 17 years old, you must have the express consent of a parent or legal guardian who agrees to these Terms on your behalf and accepts responsibility for your use of the Platform.
2.2 Event participation.
Participating in an event as a registered attendee — such as playing in a golf tournament — does not require you to be 18. Age eligibility for event participation is determined by the Organizer and the rules of the specific event.
2.3 Children under 13.
The Platform is not directed at children under 13 years of age and we do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe a child under 13 has submitted information through the Platform, please contact us at legal@chipinpro.com.
3. Payments
3.1 Payment processing.
Payments are processed by a payment processor on behalf of the Organizer. ChipIn does not store your card details.
3.2 Refunds.
Refund policies are set by the Organizer, not by ChipIn. The Organizer's refund policy, if any, will be displayed on the event page before you complete your transaction. To request a refund, contact the Organizer directly. ChipIn has no access to your payment and no ability to issue refunds on the Organizer's behalf.
3.3 Chargebacks.
If you initiate a chargeback or payment dispute with your card issuer, that dispute is between you, your card issuer, and the Organizer. ChipIn is not a party to payment disputes and will not intervene in them.
3.4 Transaction confirmation.
You will receive an email confirmation of your transaction after payment is processed. This confirmation is a record of your transaction and serves as proof of payment. It is not a tax receipt or charitable contribution acknowledgment. Any tax documentation you may be entitled to will be provided by the Organizer, not by ChipIn.
3.5 Tax.
You are solely responsible for determining how to treat your payment or donation for tax purposes. Contact the Organizer for any documentation they may provide.
4. Auctions and Bidding
4.1 Auction terms are set by the Organizer.
The rules governing each auction — including start and end times, minimum bids, bid increments, and winner determination — are set by the Organizer and displayed on the auction page. By placing a bid, you agree to those rules.
4.2 Binding bids.
A bid placed through the Platform is a binding commitment to purchase the item at your bid price if you are the winning bidder. By bidding, you authorize the Organizer to charge your payment method for the winning bid amount if your bid wins.
4.3 Outbid notifications.
If you opt in to outbid notifications, you may receive email or SMS messages notifying you when another bidder has exceeded your bid. Message and data rates may apply for SMS notifications. You can opt out of SMS notifications at any time by replying STOP to any notification message.
4.4 Item descriptions and delivery.
Auction item descriptions are provided by the Organizer. ChipIn makes no representations about the accuracy of item descriptions, the fair market value of items, or the condition in which items will be delivered. The Organizer is solely responsible for delivering auction items to winning bidders in the manner and timeframe described.
4.5 Legal compliance.
Charity auctions, raffles, and sweepstakes may be subject to specific legal requirements in your jurisdiction. Compliance with those requirements is the Organizer's responsibility. ChipIn makes no representation that any specific event or auction is legally compliant in your jurisdiction.
5. Donations
5.1 Voluntary and non-refundable.
Donations made through the Platform are voluntary. Unless the Organizer has a stated refund policy that covers donations, donations are generally non-refundable once processed. Contact the Organizer if you have questions about their donation refund policy.
5.2 Use of funds.
ChipIn has no control over and takes no responsibility for how the Organizer uses donated funds. The Organizer is solely responsible for using funds in accordance with their stated charitable purpose and applicable law.
5.3 Donor wall and public recognition.
If you choose to have your name or a dedication message displayed on a public donor wall, you consent to that information being publicly visible to other visitors to the event page. You may choose to donate anonymously at checkout if that option is available. Contact the Organizer to request removal of your name or message from a donor wall after the fact. ChipIn is not responsible for content displayed on donor walls and has no independent obligation to remove content at an End User's request.
6. Your Information
6.1 Data collected on behalf of the Organizer.
When you register, donate, or bid through a ChipIn-powered page, the personal information you provide — including your name, email address, phone number, mailing address, and payment metadata — is collected on behalf of the Organizer. The Organizer is the data controller for that information and is responsible for how it is used and protected.
6.2 ChipIn's role.
ChipIn processes your information on the Organizer's behalf as a data processor. We use it only to operate the Platform for the Organizer's event. We do not sell your personal information. We do not use your information for our own marketing without your separate consent.
6.3 Privacy rights.
To exercise any rights you may have regarding your personal information — including access, correction, or deletion — contact the Organizer directly. For questions about how ChipIn handles data at the Platform level, see our Privacy Policy at chipinpro.com/legal/privacy.
6.4 Custom fields.
Some events collect additional information through custom registration fields, such as golf handicap, shirt size, dietary preferences, or other event-specific details. This information is collected and controlled by the Organizer. Do not provide sensitive personal information unless you are comfortable with the Organizer receiving and retaining it.
7. SMS Notifications
Certain features of the Platform, including auction outbid alerts, may send SMS text messages if you provide your mobile number and opt in to receive them. The following terms apply when SMS is enabled:
- You consent to receive text messages from ChipIn on behalf of the Organizer for the specific purpose you opted in to (for example, outbid notifications).
- Message frequency varies based on your activity. Message and data rates may apply.
- To stop receiving SMS messages, reply STOP to any message. You will receive one confirmation text and then no further messages.
- For help, reply HELP to any message or contact us at legal@chipinpro.com.
- Consent to receive SMS is not required to register for an event, make a donation, or participate in an auction.
- Carriers are not liable for delayed or undelivered messages.
8. Prohibited Conduct
When using ChipIn-powered pages, you may not:
- Provide false or misleading information during registration, donation, or checkout;
- Place bids you do not intend to honor or have no ability to pay;
- Use another person's payment information without their authorization;
- Attempt to manipulate auction outcomes or registration processes;
- Use automated tools to interact with the Platform;
- Interfere with the operation of the Platform or the experience of other users; or
- Use the Platform for any unlawful purpose.
9. Platform Availability
9.1 No guarantee of availability.
ChipIn makes no warranty that the Platform will be available, uninterrupted, or error-free at any particular time. The Platform may be unavailable due to scheduled maintenance, technical issues, or circumstances outside our control. ChipIn is not responsible for any loss or inconvenience caused by Platform unavailability.
9.2 Event cancellations and changes.
If an Organizer cancels or materially changes an event after you have registered or donated, that is a matter between you and the Organizer. ChipIn has no liability for event cancellations, postponements, or changes made by Organizers.
10. Disclaimers and Limitation of Liability
10.1 Platform provided as-is.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. CHIPIN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 No liability for Organizer actions.
CHIPIN IS NOT LIABLE FOR ANY ACT OR OMISSION OF AN ORGANIZER, INCLUDING FAILURE TO DELIVER AN EVENT, FAILURE TO FULFILL AUCTION ITEMS, FAILURE TO PROCESS REFUNDS, MISUSE OF DONATED FUNDS, OR ANY OTHER BREACH OF THE ORGANIZER'S OBLIGATIONS TO YOU.
10.3 Limitation of liability.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHIPIN'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM CHIPIN'S OPERATION OF THE PLATFORM WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100). THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH YOUR CLAIM IS BASED.
10.4 No consequential damages.
CHIPIN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION WITH AN ORGANIZER, EVEN IF CHIPIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.5 Exceptions.
Nothing in these Terms limits ChipIn's liability for fraud, willful misconduct, death, or personal injury caused by negligence, or any liability that cannot be excluded under applicable law.
11. Governing Law
These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict of law principles. Mandatory consumer protection laws of your jurisdiction of residence remain unaffected by this choice of law.
Any dispute between you and ChipIn that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of the State of New Hampshire, except where applicable law requires otherwise.
12. Changes to These Terms
ChipIn may update these Terms at any time at its sole discretion by posting a revised version. The revised version of the Terms will be effective when posted. Unless otherwise stated, your use of the Platform after the revised Terms are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
